Stamped concrete driveway with the cracks filled before recolouring (Marbella)

Do I Need Permission to Paint or Restore My Driveway in Spain?

Possibly, and the answer depends on your municipality and the zone your property is in. In Andalusia, minor, technically simple works that need no project are generally handled by a declaración responsable rather than a licence, and the city of Malaga lists repairs and coatings of exterior slabs as minor works. For Marbella and the other coastal towns, the procedure has not been verified, so confirm with your ayuntamiento before work starts.

Which law decides whether you need permission in Andalusia?

The Ley 7/2021, de impulso para la sostenibilidad del territorio de Andalucía, known as LISTA. It was published in the BOJA on 3 December 2021 and came into force on 23 December 2021. Its Title VI regulates which acts need a licence and which can be done with a declaración responsable or prior notice.

The detail sits in its General Regulation, approved by Decreto 550/2022 of 29 November and published in the BOJA on 2 December 2022. Title VI of that Regulation, articles 280 to 337, covers licences, declaraciones responsables and prior notices.

What is the difference between a licence and a declaración responsable?

A licence is an express authorisation that the town hall grants before work begins; article 137 of the LISTA lists the acts that need one. A declaración responsable is a statement by the owner that the work meets the rules, submitted to the town hall; article 138 lists the acts that can use this route.

According to a municipal form that quotes it, article 138.1.a includes ‘obras de escasa entidad constructiva y sencillez técnica que no requieran proyecto’: minor works of simple technical character that do not require a project. We could not read the full official text of article 138 (to be verified).

A restoration of the kind we carry out involves no demolition and no new construction, but whether it needs a declaración responsable, a licence or nothing is decided by your municipality, not by the contractor.

What does the city of Malaga say?

Malaga city’s urban planning office publishes Annex I.1, a list of works subject to licences or declaraciones responsables. Minor, technically simple works that need no project generally go through a declaración responsable, although in some areas, such as protected settings, a licence is required.

The city’s tax ordinance on planning fees, Ordenanza Fiscal nº 15, lists under item A.2.12 exterior works in gardens, pools or common areas that do not affect the façade, the roof or the public road and consist only of repair, coatings and slabs. Item A.2.11 covers coatings and paints. Both carry a municipal fee; the version in force is not dated on the page.

In plain terms: in Malaga city, repairing and coating an exterior slab is treated as a minor work, usually by declaración responsable with a fee, unless the zone calls for a licence.

What about Marbella, Estepona, Mijas and the other coastal towns?

We have not been able to verify the procedure for Marbella, Estepona, Mijas, Fuengirola, Benalmádena or Torremolinos (to be verified). The official pages and ordinances were not available to us, and we will not repeat what third-party websites claim.

The safe position is this: depending on the municipality and the zone, a declaración responsable or a licence may be required, and the owner should confirm it with the ayuntamiento before starting. If you live abroad, your property manager, gestor or lawyer can make the enquiry for you.

Who is responsible for checking: the owner or the contractor?

The owner, because the declaración responsable or licence relates to the property and is submitted in the owner’s name. We describe the work clearly in our quote, which is the information a town hall will want to see, and we can provide it in Spanish.

For holiday homes and second homes, this is one of the tasks worth delegating to someone local well before the planned dates. Our villa terrace refresh page explains how we plan around owners who are not in Spain.

Do communities of owners need permission too?

The planning rules apply to the property regardless of who orders the work, so a community restoring a shared driveway or ramp faces the same municipal question. Malaga city’s item A.2.12 explicitly mentions common areas.

In a community, the administrador usually handles the paperwork alongside the internal approval under the Ley de Propiedad Horizontal. Our communal surfaces page and the community approval guide cover that side.

What rules apply to waste and wash water?

A restoration produces no demolition rubble, because nothing is broken up. Construction and demolition waste in Spain is regulated by Real Decreto 105/2008, and avoiding demolition avoids most of that waste stream altogether.

Cleaning does produce dirty water and residues. In the city of Malaga, the sanitation regulation, article 17 and Annex 1, bans discharging into the sewer water-immiscible solvents, paints and pigments that normal treatment cannot remove, and solids that can obstruct the network.

Benalmádena has a similar ordinance, of which only the initially approved text was found. For Marbella, no ordinance could be verified.

What should you do before booking the work?

Ask your ayuntamiento which procedure applies to your address, keep a copy of any declaración responsable or licence, and share the quote’s description of the work with whoever submits it. Then plan the dates.

Frequently asked questions

Do I need a licence to paint my driveway in Spain?

It depends on the municipality and the zone. In Andalusia, minor, technically simple works that need no project generally go through a declaración responsable rather than a licence, but protected areas can require a licence. Confirm with your ayuntamiento before starting, because the procedure varies by town.

What is a declaración responsable?

It is a statement submitted by the owner to the town hall declaring that the planned work meets the applicable rules. Under the LISTA, article 138 lists the acts that can use this route instead of a licence. It is generally simpler than a licence but still has to be submitted where required.

What does Malaga city require for restoring a terrace?

Malaga city lists repairs, coatings and slabs in gardens, pools or common areas that do not affect the façade, roof or public road as a minor work under item A.2.12 of its planning fee ordinance. These generally go by declaración responsable with a fee, unless the zone requires a licence.

What about Marbella?

We could not verify Marbella’s procedure for this type of work (to be verified). Depending on the zone, a declaración responsable or a licence may be needed. Please confirm with the Ayuntamiento de Marbella before the work starts, or ask your gestor or property manager to check.

Is the contractor responsible for the permit?

The procedure relates to the property and is normally submitted in the owner’s name. We provide a clear written description of the work, in Spanish if needed, so that the owner or their representative can include it in the submission.

Does a community of owners need permission to restore a shared driveway?

The municipal rules apply to the property regardless of who orders the work. Malaga city’s fee item A.2.12 explicitly includes common areas. Communities also need to follow the Ley de Propiedad Horizontal for internal approval, which the administrador usually manages.

Is there a fee for a declaración responsable in Malaga?

Yes. Malaga city’s Ordenanza Fiscal nº 15 lists a fee for exterior repairs and coatings under item A.2.12, and for coatings and paints under A.2.11. The page does not state which version of the ordinance is in force, so check the current amount with the town hall.

Does restoring a driveway create construction waste?

Very little, because nothing is demolished. Real Decreto 105/2008 regulates construction and demolition waste in Spain. A restoration avoids the rubble that a replacement produces, though cleaning still creates wash water and residues that must be handled properly. That makes restoration a lighter option from a waste point of view too.

Can wash water go down the drain?

Not if it contains paints, pigments or solvents that normal treatment cannot remove. In Malaga city, the sanitation regulation bans such discharges into the sewer. Rules in other towns were not all verified, so residues are handled with that restriction in mind.

Where can I read the law myself?

The sources are listed at the foot of this guide: the LISTA and its Regulation in the BOJA, Malaga city’s planning annex and fee ordinance, Real Decreto 105/2008 and Malaga’s sanitation regulation. Some documents are in Spanish only.

Can someone check the procedure for me while I am abroad?

Yes. A gestor, lawyer, property manager or trusted neighbour can ask the ayuntamiento which procedure applies at your address. Give them our written description of the work so that the question is precise. Ask them to keep a copy of any declaración responsable or licence for your records.
